1. Agreement to Terms

By accessing or using Luna's Room (lunasroom.com) and its services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Alexander Bakharev, a sole proprietorship registered in Portugal ("we," "us," "our").

2. Description of Service

Luna's Room is an AI-powered entertainment platform featuring AI-generated character content and conversational AI chat functionality. The Service uses artificial intelligence to generate text responses, images, and other content.

Important Disclosure: You are interacting with an AI system, not a human. Luna is a fictional AI character. All content, including images, text, and personality, is artificially generated.

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age. We do not knowingly provide services to individuals under 18.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts at our sole discretion.

5. Subscription and Payments

5.1 Subscription Tiers

The Service offers free and paid subscription tiers. Features and pricing are displayed on the website and may change at any time.

5.2 Billing

Paid subscriptions are billed in advance on a recurring basis (monthly). Payment is processed through Stripe.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5.4 Refunds

All sales are final. Refunds are provided only where required by applicable law (including the 14-day withdrawal right for EU consumers under the Consumer Rights Directive, which you expressly waive upon immediate access to digital content with your prior consent).

5.5 Price Changes

We may change subscription prices at any time. Price changes will be notified at least 30 days in advance and will apply to the next billing cycle.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to harm minors in any way
• Impersonate any person or entity
• Use automated systems, bots, or scripts to access the Service without our written permission
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Use the Service to develop competing products or services
• Share account credentials or allow others to access your account
• Circumvent any access restrictions or usage limits

Violation of these terms may result in immediate termination of your account without refund.

7. AI Disclaimer and Limitations

7.1 AI-Generated Content

All content generated by the AI is provided for entertainment purposes only. The AI may produce inaccurate, incomplete, or inappropriate responses. We do not guarantee the accuracy, reliability, or quality of any AI-generated content.

7.2 No Professional Advice

The Service does NOT provide:

• Medical, mental health, or psychological advice or treatment
• Legal, financial, or professional advice
• Emergency services or crisis intervention

The Service is not a substitute for professional help. If you are experiencing a mental health crisis, medical emergency, or thoughts of self-harm, please contact emergency services or a mental health professional immediately.

7.3 No Human Interaction

Luna is an AI character. Any perceived emotional connection, relationship, or companionship is simulated. We make no representations about the therapeutic or emotional benefits of using the Service.

8. Intellectual Property

8.1 Our Content

All content on the Service, including but not limited to text, graphics, logos, images, software, and AI models, is our property or licensed to us. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 User Content

You retain ownership of content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for providing and improving the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation.

9. Privacy and Data

Your use of the Service is subject to our Privacy Policy, which is incorporated by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

Your conversation data may be processed to provide responses and may be used to improve the Service. We process data in accordance with the EU General Data Protection Regulation (GDPR).

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any defects will be corrected
• The Service will meet your requirements or expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR €50, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

You may terminate your account at any time by deleting your account through the settings or contacting us.

13.2 By Us

We may suspend or terminate your access at any time, for any reason, without notice. Reasons may include, but are not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Non-payment

Upon termination, your right to use the Service ceases immediately. We may delete your account data at our discretion.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict of law principles.

14.2 Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Portugal.

14.3 EU Consumer Rights

If you are a consumer in the European Union, you retain any mandatory consumer protection rights under the laws of your country of residence.

15. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

For material changes, we will provide notice through the Service or via email at least 30 days before the changes take effect.
